Family Court of Australia

 

What does this court do and who can appear?

 

This court is Australia's superior family law court and its purpose is to:

 

  • Hear and determine complex law, facts and many parties;

 

  • Cover specialised areas in family law; and

 

  • Provide national coverage as the appellant court in family law matters.

 

It deals with complex family law matters such as parenting cases, allegation of physical or sexual abuse, family violence, child abduction, parenting orders, and many other complex legal matters.

 

Anyone involved in the dispute can appear at the court such as parents, step-parents, immediate and other family members, etc.

 

When hearing parenting orders the court is to regard the best interest of child as its most important consideration, these same principles applies when the court makes parenting orders.
 

In divorce proceedings the court follows the established principle of no-fault divorce. The court instead looks to the irretrievable breakdown of the relationship which is to be demonstrated by 12 months of separation.
