Federal Magistrates Court of Australia


Formerly known as the Federal Magistrates Court of Australia, on the 13th September 2012 a decision was made by the Attorney-General to change the name of this court to the “Federal Circuit Court of Australia”. Note that this name change does not appear to have affected anything within the Court itself – so all proceedings should remain as normal.

Note that, as part of this new name-changing regime, Federal Magistrates will now be referred to as “Judges”. The rationale behind this was to recognise the important service that the Court provided to rural and regional communities. The objective of this court is to provide simple options to litigation in the Federal Court of Australia and the Family Court of Australia and to also relieve the workload of these two courts.

What does this court do?

The court hears the following matters:

  • Family law and child support 

  • Administrative law 

  • Admiralty law 

  • Bankruptcy 

  • Copyright 

  • Human rights 

  • Industrial law 

  • Migration 

  • Privacy 

  • Trade practices 

Who can appear?

You can apply to the court if the court has jurisdiction as listed above to hear your case.

Court Location

The Federal Circuit Court is based in the same premises as the other Federal Courts.

 Its primary locations are Melbourne, Dandenong, Sydney, Adelaide, Brisbane, Cairns, Canberra, Darwin, Launceston, Hobart, Newcastle, Parramatta, Perth and Townsville.

 In addition, the court conducts regular circuits (sittings) in other regional and metropolitan locations.
